Arkansas State Police has filed a motion to dismiss a FOIA violation lawsuit against them. According to court documents, ASP stated the complaint of the plaintiff, Matthew Campbell, should be dismissed based on the “rule of civil procedure.” In their filing, they stated that “the ASP is an improper party because it is not the custodian of the records, and it did not allegedly deny the Plaintiff’s FOIA rights.” Attorney General Tim Griffin filed a brief in support of the dismissal from state police. In part, Griffin states that the plaintiff in this case did not give “valid service of process” and that “the Court does not have subject-matter jurisdiction over the Plaintiff’s first FOIA request and that the ASP is not the custodian of the records.”Click here for a link to the complete filing. “The Plaintiff’s complaint is procedurally deficient and should be dismissed.
